1. Personalization & Accuracy

• Customer Responsibility: Explorer Factory is not liable for errors in location names or coordinates provided by the customer. It is the buyer’s sole responsibility to verify the accuracy of the location data and spelling before finalizing the order. We map exactly what is provided in the personalization field.
• Right of Refusal: We reserve the right to refuse and cancel any order containing coordinates or location names associated with hate speech, illegal activities, offensive monuments, or content that violates our brand values or local laws. In such cases, a full refund will be issued, and the contract will be voided.
• No Endorsement: The printing of specific coordinates does not constitute an endorsement by Explorer Factory (or Raphael Senft) of the events, ideologies, or entities associated with that specific location.

2. Custom Nature of Goods & Refunds

• Exclusion of Right of Withdrawal (Worldwide): Pursuant to the Swiss Code of Obligations and the EU Consumer Rights Directive, the 14-day right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized. This policy applies to all orders globally, regardless of the buyer’s location.
• Final Sale: Because every piece is uniquely custom-printed based on your specific coordinates, all sales are final. Orders cannot be canceled, returned, or refunded once production has begun.
• Replacements: We only offer replacements or refunds in the event of a documented manufacturing defect or a printing error on our part. Claims for defects must be submitted within 14 days of delivery with photographic evidence.

3. Product Representation & Use:

• Color and Sizing: Due to variations in monitor settings and the digital nature of Print-on-Demand (POD), final product colors and print placement may vary slightly from the screen preview. Customers are responsible for reviewing the provided size charts; we cannot offer exchanges for sizing errors.
• Intended Use: Our clothing and gear are intended for standard leisure use only. They are not technical safety equipment, flame retardant, or professional-grade outdoor survival gear. Explorer Factory disclaims all liability for use outside of standard leisure activities.

4. Limitation of Liability

• Third-Party Partners: While we vet our partners (e.g., Printful) for high standards, Explorer Factory is not liable for indirect or consequential damages resulting from the manufacturing or third-party delivery process.
• Force Majeure: We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, shipping strikes, or global supply chain disruptions.
• Materials & Allergies: Material compositions are listed in product descriptions. It is the buyer’s responsibility to review these for potential allergies or skin sensitivities.
• Liability Cap: To the maximum extent permitted by Swiss law, the total liability of Explorer Factory and Raphael Senft for any claim arising out of the purchase or use of our products shall not exceed the actual purchase price paid for the item.

5. Customs, Taxes & Jurisdiction

• Import Obligations: Buyers are responsible for any customs and import taxes that may apply in their home country. Explorer Factory is not responsible for delays or additional costs held by customs authorities.
• Electronic Communication: You agree that all agreements, notices, and other communications provided to you electronically (via Etsy messages or email) satisfy any legal requirement that such communications be in writing.
• Governing Law & Language: These terms are governed by the laws of Switzerland. The primary language of this contract is English. Any translations provided are for convenience only.
• Dispute Resolution & Costs: In the event of a dispute, both parties agree to first attempt to resolve the matter through informal mediation (e.g., via the Etsy Dispute Resolution system).
• Jurisdiction: The exclusive place of jurisdiction for all legal disputes is Basel, Switzerland. To the extent permitted by law, the prevailing party in any legal action shall be entitled to recover their reasonable attorney’s fees and legal costs.
